… as judge rules Scott’s mum has case to answer The crown has built up a prima facie case against the accused in which Koalabata residents Lehlohonolo Scott and his mother are charged with two counts of murder, therefore, Lehlohonolo’s mother has a case to answer, High Court Judge Teboho Moiloa ruled.

Moiloa said this on Tuesday this week before dismissing an application in which Lehlohonolo’s mother ’Malehlohonolo was asking the court to discharge her. Delivering an extempore judgment in the absence of Scott’s mother, Judge Moiloa explained that the court considered the evidence of Lehlohonolo that the Koalabata residence belonged to him against that of Koalabata area Chief ’Makhomo Makoanyane who testified as  having known that the residence belonging to Scott’s mother and not her son.

Justice Moiloa indicated that the court researched about the time Lehlohonolo alleged he first owned the residence and realised that he was too young at the time. The judge said he could not have secured any plot and, even according to the laws of this country, no land is allocated minors but only elders. Given this evidence Judge Moiloa said his court is forced to believe the evidence of Chief Makoanyane over that of Lehlohonolo.

Judge Moiloa also indicated that there is no evidence before court suggesting that Scott's mother had no access to any of the rooms at her
house and that she cannot expect the court to believe her evidence that she was not aware of the items hidden in the house like the bloody package that was recovered by investigating officers.

Concerning the vehicle which allegedly belongs to Lehlohonolo and which most of the Koalabata residents had seen him driving, Judge Moiloa explained that it is surprising that his court can be expected to believe Scott’s mother's evidence that she did not know the car at all and that she could not even see flies from the hidden body parts coming from it nor did she detect any smell.

Judge Moiloa also commented that there is unchallenged evidence before court that police officers also saw some blood stains in the toilet belonging to the Scott’s and that the court also finds it difficult to believe that Scott's mother knew nothing about the stains while the toilet was still in normal use. It is after the judgment was delivered that the court announced it shall proceed with the case on June 18, 2019.

Lehlohonolo and his mother are charged with the brutal murders of two Koalabata boys Moholobela Seetsa and Kamohelo Mohata that
happened in 2012. The Scott’s are represented by Advocate Thulo Hoeane while the crown is represented by Senior Counsel, Advocate Gareth Leppan assisted by Advocate Thapelo Mokuku.
