STAFF REPORTER Justice Molefi Makara will next week Tuesday hear a matter in which members of the Basotho National Party (BNP) have taken their ruling party to task for proposing to hold an annual general conference, which they contend is in contravention of the provisions of the party’s constitution.

The seven applicants comprise Odilon Cekwane, Mothibeli Rateronko, Tanki Raboroko, Thabiso Majalle and 'Manthati Tlali, Senate Bereng as well as ’Makhotso Mafeto. The applicants are drawn from various constituencies across the country. They have cited BNP, its national executive committee and 36 other members as respondents in the case that was scheduled to be heard on Tuesday. But the matter was postponed to next week Tuesday because the respondents filed opposing papers.

In their urgent application filed on Monday, the applicants want the respondents to show cause if any, why the court cannot stay the NEC’s decision to announce and call for holding of the conference scheduled for July 12, pending completion of the matter. They also want the respondents to tell the court why the NEC’s calling of the annual general conference shall not be reviewed, corrected and set aside. They also want to know why the NEC cannot be ordered to announce and call for holding of the conference in full compliance of the constitution.

The constitution stipulates that the notice period given to members is full 90 days prior to holding of the conference or any other reasonable period. The applicants further want the respondents to explain why the party’s Circular No. 3 of 2019 shall not be declared null and void. They also want to know why the election for the nomination of candidates as constituencies committee members of the party for the Qacha’s Nek, Qoaling, Qhalasi and Mafeteng constituencies cannot be reviewed, corrected and set aside and fresh elections be held.
Advocate Letuka Molati appears for all applicants while the respondents are represented by Advocates Christopher Lephuthing, Monaheng Rasekoai and Koili Ndebele.
