THE matter in which former army commander Lieutenant General Tlali Kamoli and eight other soldiers face a battery of charges including murder was on Monday postponed until February 5, 2021 because there is insufficient evidence for the trial to commence.

The prosecution told the court that there is no positive feedback on the part of government to secure a record of proceedings of the Justice Phumaphe’s Commission of Inquiry from the SADC secretariat in Botswana.

In November the prosecution had shown that arrangements were underway to secure the record in question to be presented in court as part of evidence.

The other accused soldiers include Motsamai Fako, Motšoane Machae, Tšitso Ramoholi, Litekanyo Nyakane, Haleo Makara, Lekhooa Moepi, Marasi 'Moleli and Mohlalefi Seitlheko.

They face several charges including the murder of former army chief Lt Gen Maaparankoe Mahao along with multiple counts of attempted murder, theft, obstruction of justice, damage to property, aggravated assault and risk of injury or death.

Most of these crimes allegedly occurred in Ha Lekete and Ha Ratjomose in Maseru on June 25, 2015 - the day on which Mahao was killed.
The Phumaphe Commission had been established to determine among others, circumstances surrounding Mahao’s death.

The case is continues before Justice Charles Hungwe.
