LAWYER representing the former army boss, Lieutenant General Tlali Kamoli in a matter in which he is accused with other soldiers of the murder of his predecessor Lt Gen Maaparankoe Mahao has revealed some of the submissions he will make when all evidence in the trial has been led.

Crossing examining the first witness in the case Lance Corporal Mokete Halahala, Advocate Letuka Molati said will among others submit that his client was not responsible for the operation meant to arrest people suspected of mutiny in 2015.

He said Kamoli is only being detained for mahao’s murder to deliberately spite him.

The mutiny suspects, he said have either been promoted or kept at work beyond their retirement period in order to conceal certain information required by the court.

He said he will submit that the State is deliberately denying the defense access to the Phumaphi Commission report.

After Mahao’s murder, a commission facilitated by the Southern African Development Community (SADC) was established to determine circumstances surrounding the murder.

When the trial commenced, the defence requested a report compiled in respect of the commission, which was spearheaded by Botswana judge, Justice Mphaphi Phumaphi.

The defence argued that the report would form an integral part of the evidence intended to defend the accused.

The Crown has however, since been dilly dallying to hand over the sought report.
Kamoli is charged along with Motsamai Fako, Motšoane Machae, Tšitso Ramoholi, Litekanyo Nyakane, Haleo Makara, Lekhooa Moepi, Marasi 'Moleli and Mohlalefi Seitlheko.

The accused also face charges including attempted murder, theft, obstruction of justice, damage to property, aggravated assault and risk of injury or death.
Most of the crimes allegedly occurred in Ha Lekete and the Ratjomose army headquarters in Maseru on June 25, 2015, the day on which Mahao was allegedly executed.  LeNA/METRO
