MASERU - The Crown in a matter in which soldiers and police are accused among others of murder and want the state to pay their legal fees contends that the applicants do not deserve that aid because they are still in government’s payroll.

About 40 officers who are currently detained at the Maseru Central Prison for both murder and attempted murder have approached the High Court arguing that they needed assistance to pay their legal fees. But Advocate Christopher Lephuthing on behalf of the Crown on Monday said the officers did not qualify for prodeo services because they could afford to pay their own lawyers.

However, Attorney Qhalehang Letsika who appears for the applicants said the charges his clients face attracted capital punishment, hence they needed the best legal brains in their corner. Attorney Letsika said the government had engaged foreign Judges and a prosecutor for the cases, adding therefore that it was only fair that the applicants could get best legal representation too.

A ruling on the application will be delivered on Tuesday by acting High Court judge Justice Charles Hungwe from Zimbabwe. The applicants are charged with the murders of former army commander Lieutenant General Maaparankoe Mahao, Police Constable Mokalekale Khetheng and Sub-Inspector Mokheseng Ramahloko of the LMPS along with Lekhoele Noko, Khothatso Makibinyane and Molise Pakela.
