A senior prosecutor at the Maseru Magistrate's Court who is unhappy with his transfer to the Law Office in Maseru has challenged the move, saying it is unlawful.

In his application filed in the High Court this week, Advocate Lehlohonolo Phooko argues that his transfer was irregular as the Principal Secretary (PS) in the Ministry of Law, Constitutional Affairs and Human Rights has no authority to reallocate him without affording him a hearing.

He has cited the PS in question as the first respondent in the matter.
Phooko contends that the PS failed to comply with the human resources and development policy manual, hence, the decision to move him to another office is unlawful.

He says while he held a managerial position at the Maseru Prosecution Office where he was the Chairperson of the Justice Sector Committee, he is now idling at the Law Office.
He adds that he is now no longer entitled to the benefits of his former senior position.

He further argues that he has several cases pending in the Magistrate’s Court owing to the transfer. - LeNA
