A HIGH Court judge has ordered one of the five soldiers who face the 2012 murder of three Mafeteng residents to stand trial as he is mentally fit to be prosecuted.

Accused soldier ordered to stand trial

Justice Onkemetse Tshosa’s order followed a medical report which was filed before the court pronouncing Khauhelo Makoa as fit to stand trial.
The report came after Makoa was taken for psychiatric assessment in order to determine whether or not he is mentally fit to be prosecuted.
Makoa’s lawyer had previously filed an application in terms of section 172 (1) of the Criminal Procedure and Evidence (CP&E) Act relating to his client’s mental state.
But Dr Tshosa on Monday showed that not much could be said about the expert's report.
He said requirements of the section had been fully satisfied and there was no doubt that the accused could be prosecuted.

He concluded that both the report and its contents were accepted by the court as part of evidence.
Makoa is charged together with Litekanyo Nyakane, Sebilo Sebilo, Tšepo Tlhakeli and Thebe Tšepe for the murder of Thabang Mosole, Monyane Matsie and Pakiso Ntala Letatabe on April 7, 2012 in Ha Motanyane, Mafeteng.
