JUSTICE Charles Hungwe on Thursday prohibited video recording of evidence of the first witness in the matter in which members of LDF are charged with the murder of former army boss, Lt Gen Maaparankoe Mahao.

This after the witness, Lance Corporal Mokete Halahala told the court that he was uncomfortable with his testimony being recorded.

The defense challenged the prohibition of the video recording with Advocate Letuka Molati arguing that evidence may only be taken 'in camera' when a minor is involved or when security is jeopardised.

He said no one will suffer prejudice if the evidence is video recorded, adding that no ends of justice will be defeated.
Attorney Qhalehang Letsika who also defends some of the accused said the trial has to be in public, adding that it is in their best interest if the evidence is recorded.

For his part, Adv Napo Mafaesa submitted that due to the COVID-19 pandemic, members of the public are unable to attend court cases, hence the recording of proceedings.

On behalf of the Crown, Senior Counsel Shaun Abrahams argued that because Halahala said he was uncomfortable with the video recording, he should therefore be allowed to testify freely.

The accused in the matter include former LDF commander Lt Gen Tlali Kamoli along with Motsamai Fako, Motšoane Machae, Tšitso Ramoholi, Litekanyo Nyakane, Haleo Makara, Lekhooa Moepi, Marasi 'Moleli and Mohlalefi Seitlheko.

They face multiple charges including attempted murder, theft, obstruction of justice, damage to property, aggravated assault and risk of injury or death.
Most of these crimes allegedly occurred in Ha Lekete and Ha Ratjomose in Maseru on June 25, 2015, the day Mahao was killed execution style. LeNA
