THE High Court will on Tuesday next week decide whether to try the soldiers accused of the 2014 bombing attacks in Maseru or remit the case to the subordinate court like the accused want.

The accused include the former army boss Lieutenant General Tlali Kamoli along with Litekanyo Nyakane, Malefane Heqoa, Mohlalefi Seitlheko and Pitso Ramoepana. They face multiple charges including attempted murder, aggravated assault, risk of injury or death and unlawful damage to property.

Kamoli faces additional charges including defeating ends of justice and issuing unlawful superior orders.
The accused had on Thursday argued that the court lacks jurisdiction to try them, saying their case should be heard by a magistrate.

Their lawyers argued that the Director of Public Prosecutions (DPP) acted incorrectly when she indicted them in the High Court.
But the prosecution which is spearheaded by Senior Counsel Shaun Abrahams submitted that the interest of justice dictates that the matter be heard by the High Court.

He said the DPP's decision was well considered, adding that the safety and security of the state, along with the interest of the public and the administration of justice were also considered.

The accused are alleged to have acted together with the late Tefo Hashatsi to bomb the Moshoeshoe II residences of Liabiloe Ramoholi (now ’Maesaiah Thabane), ’Mamoletsane Moletsane and Khothatso Tsooana’s home in Ha Abia in January 2014.
