EVIDENCE in the murder trial of Police Constable Mokalekale Khetheng shows that the deceased policeman was never arrested for arson like the Crown submits.

This was revealed by King’s Counsel Zwelakhe Mda who represents one of the accused, Inspector Mothibeli Mofolo.

The development emerged during the cross examination of one of the witnesses, Sergeant Khothatso Mphutlane of the Hlotse Police who  testified in the case that continued before Justice Charles Hungwe on Monday.

Mphutlane had earlier told the High Court how she was part of a team of investigators that arrested the late Khetheng on March 26, 2016 before handing him over to Mofolo who was their superior officer.

But Mda submitted that his client will show that there is no record to support Khetheng’s alleged arrest.

He said Mofolo will further testify that he instructed the police team under his command to take Khetheng to the station but not to arrest him, as their district commander, Senior Superintendent Tšukulu wanted to see him.

Both Mofolo and Tšukulu are accused along with two other Hlotse police officers, Mabitle Matona and Haleokoe Taasoane of the murder of Khetheng.

The four also face other charges including perjury and defeating ends of justice.
